FleetHunt Technologies LLP is hereinafter collectively referred to as “FLEETHUNT”.
The service offerings are at the full discretion of FLEETHUNT. Technical feasibility needs to be established before providing the service.
Customer acknowledges that the FLEETHUNT Fleet Management System / Smart Car Security System (hereinafter referred to as the “service”) rendered by FLEETHUNT hereunder is based on wireless data technology. The availability, accuracy and quality of the service may be affected by various factors not within the control of FLEETHUNT, including but not limited to physical obstruction, availability or performance of the network, geographic conditions, radio signal interference, non-availability of power, faults or modifications in other telecommunication networks to which the FLEETHUNT network is connected, non-receipt or delay in receipt of suitable right of way, equipment damage, modification of equipment or infrastructure, or any other reason not within the control of FLEETHUNT. In connection with the foregoing, FLEETHUNT does not guarantee an uninterrupted or fault-free service and shall not be responsible for any delays or errors in the transmission of the service.
The service is provided in India to Indian citizens residing in India, aged 18 years and above, who are entitled to enter into a legally valid and enforceable contract and are not under any legal disability.
This information is to be used for “guiding purposes only” and shall not be used for any detection, claim, damage, dispute or illegal purpose. FLEETHUNT shall not be responsible for any claim of any nature other than a claim relating to a disruption in service due to an act or omission of FLEETHUNT.
Customer shall be solely responsible for protecting the tracking device, two-way communication and all other sensors provided by FLEETHUNT from misuse, theft or damage. In the event of any damage to such equipment, the customer shall approach the equipment manufacturer or its authorised service centre for repairs.
FLEETHUNT shall not be responsible for any breach of privacy obligations between the customer and any other person being tracked, viewed, filmed or recorded through the service. Customer shall indemnify and keep FLEETHUNT, its officers, employees, directors, affiliates, contractors, agents and vendors fully indemnified and harmless against any such claims and obligations.
It shall be the responsibility of the customer to provide correct inputs and data to FLEETHUNT for availing the service. Customer shall be required to provide correct, accurate and updated details of himself/herself, including details relating to age, address, identity and ownership of the vehicle, and must submit all necessary proof for authenticating the details provided for availing the service. FLEETHUNT shall not be under any obligation, but shall be entitled, to verify the details provided by the customer, and in case of any discrepancy found in those details FLEETHUNT shall be entitled to immediately discontinue offering the service to such customer.
FLEETHUNT reserves the right to discontinue providing the service to any customer who violates any of the terms and conditions of the service. Any customer providing incorrect information, or concealing or withholding any information from FLEETHUNT with an intent to avail the service, will automatically be disqualified from availing the service. Providing incorrect information or concealing or withholding information includes, but is not limited to, incorrect declaration of name, age, identity, address, mobile connection, ownership of vehicle, domicile or any other information provided or withheld by the customer.
Customer indulgence in any activity which is untoward, illegal, antisocial or criminal in nature, or any attempt at any such activity which may be construed as or result in, imply or culminate in an untoward, illegal, antisocial or criminal activity, will result in immediate discontinuation of the service and disassociation of FLEETHUNT from the customer, and may invite criminal proceedings against the customer.

FLEETHUNT reserves the right to terminate the service in the event of non-payment of outstanding bills issued by FLEETHUNT in accordance with the tariff plans opted for by the customer and the extent of usage, or any default on the part of the customer.
Billing with respect to the subscription and usage of this service will be done separately.
FLEETHUNT shall not be responsible for any actions taken by its customers or others as a result of its services.
The customer shall be required to purchase the equipment from direct sales associates and dealers authorised by FLEETHUNT for the sale of equipment. FLEETHUNT shall not be under any obligation to provide any service to the customer if the equipment is purchased from an entity other than such direct sales associates and authorised dealers.
All charges and tariffs for the service other than the equipment will be as per the choices made by the customer or as per the company's subscription plan.
The customer shall be solely responsible for any illegal use of the equipment and/or service and shall defend, indemnify and hold harmless FLEETHUNT and its directors, officers and employees (or any of them) against any claim, liability, demand, loss, damage, judgment or other obligation or right of action which may arise out of such illegal use of the equipment and/or the service.
The customer shall be liable to duly honour all payments relating to the equipment and services without any delay or default. FLEETHUNT reserves the absolute right to take appropriate legal action against the customer in the event the customer delays or defaults in making payment of any amounts due and payable. The customer shall be solely responsible and liable for the sanctity and management of the web and mobile access, username and password provided by FLEETHUNT. FLEETHUNT shall not be responsible for any cost, expense, damage, claim, demand, suit or prosecution arising due to mismanagement, breach of requisite security level, hacking of web and mobile access, username and password, or similar incidents.
The customer understands and agrees that the accuracy and latency of the service depend on various factors, considering the involvement of a range of technologies such as the cellular network and internet at the source device as well as at the access device (customer laptop, desktop or mobile). Hence the customer agrees and undertakes to use this service for tracking and security purposes only.
FLEETHUNT agrees to provide the service on a best-effort basis, but does not take any responsibility for the accuracy or latency of the input feed, and the same should not be used for any detection, claim, damage, dispute or legal purpose by the customer or anyone acting for or on behalf of the customer. No third-party claim of any nature will be entertained by FLEETHUNT in this regard.
The customer shall access our website “fleethunt.in” and set his/her username and password for portal access to track his or her vehicle registered under the service on “fleethunt.in”.
The customer is responsible for preserving the web and mobile username and password, and FLEETHUNT shall not be responsible for any mismanagement or confidentiality breach of the username and password.
The customer shall, at his/her sole cost and consequence, be free to share his/her web and mobile username and password with any number of third parties at his/her discretion, and to allow any third party to track him/her on the web portal with that username and password. However, FLEETHUNT shall not be responsible for any misuse of the username and password, and any claim, demand, damage, suit, cost or expense in this regard will not be entertained by FLEETHUNT.
FLEETHUNT shall not be responsible for any breach of privacy obligations between third parties or whosoever is being tracked through the equipment, and it shall be the sole and exclusive responsibility of the customer to inform all concerned that the vehicle is under surveillance and that equipment is installed in the vehicle for tracking it.
FLEETHUNT shall not be responsible for any default, failure, deficiency or inaccuracy in the service due to any reason not within the control of FLEETHUNT. The customer undertakes not to raise any claim, demand, damage, cost or expense against FLEETHUNT.
FLEETHUNT reserves the right to change, modify or terminate the service at any time at its own discretion by giving prior notice, but without assigning reasons, to the customer.
The right to use the service is subject at all times to the terms and conditions of the service as specified on www.fleethunt.in.
FLEETHUNT may temporarily deactivate, stop or discontinue this service for maintenance purposes with prior notice to the customer.
FLEETHUNT shall be entitled to change, alter, modify, cancel or suspend the service as it may deem fit, either consequent to any statutory or regulatory order or direction, or on account of any other reason.
The service is non-endorsable, non-transferable and non-substitutable.
FLEETHUNT shall not be liable for any failure to comply with its obligations caused by fire, flood, strike, hurricane, industrial dispute, war, hostilities, political unrest, riots, civil commotion, terror attack, inevitable accidents, acts of God or any other circumstances amounting to force majeure.
FLEETHUNT shall not be responsible for any loss or damage if it has to discontinue or cancel this service in compliance with any law, ruling, order, regulation, circular, notification, requirement or instruction of any central or state government, or for any other unavoidable reason beyond its control. The customer shall be informed of such discontinuance or cancellation as soon as possible.
The decision of FLEETHUNT as to the interpretation of any of these terms and conditions shall be final and binding on the customer.
FLEETHUNT shall not be responsible for any loss, damage, cost, expense, claim or demand raised by the customer or any other person acting for or on behalf of the customer due to any of the following reasons:
1. Customer is unable to use the service due to any reason not within the control of FLEETHUNT.
2. Customer is unable to subscribe to the service due to any other reason beyond the control of FLEETHUNT.
3. Customer is unable to understand the terms and conditions of the service.
4. Customer is unable to understand the process of activation of the service or is unable to activate the service.
5. Customer is not complying with any of the terms and conditions of the service.
6. Customer has violated any of the terms and conditions of the service.
7. Customer defaults in making payment to FLEETHUNT with respect to the equipment purchased and/or services availed.
8. Any other reason not within the control of FLEETHUNT.
In order to avail the service from FLEETHUNT, the customer shall be required to furnish the request application form, photograph and other information and documents as may be specified by FLEETHUNT, and the relationship between FLEETHUNT and the customer with respect to the service shall be governed by the provisions of the said application and other applicable documents submitted or furnished by the customer or issued by FLEETHUNT.
The courts in the town or city where the FLEETHUNT office whose address is mentioned in the service enrolment form is located shall have sole and exclusive jurisdiction to decide any dispute under the service enrolment form.
Apart from these terms and conditions, there are no oral or implied agreements, and no oral or implied warranties or understandings, between FLEETHUNT and the customer with respect to the subject matter hereof.
The mobile SIM number fitted in the FLEETHUNT device, as mentioned on the warranty card, will be used exclusively for the vehicle tracking system. Misuse of the SIM card for anything other than the tracking system, thereby creating any problems, will be the responsibility of the customer, who will be liable to legal consequences at the cost of the user.
